Kimie is operated by Nagare Business Flow Lab (ABN 32 542 463 012), trading as Kimie (“Kimie”, “we”, “us”). These terms are governed by the law of Australia and apply to the whole Kimie service: this website (kimie.com.au) and the Kimie product app (app.kimie.com.au). The specific state or territory whose courts have jurisdiction over a dispute isn’t settled yet — that’s flagged here for legal review rather than decided. By creating a recruiter account or otherwise using Kimie, you agree to these terms. Questions about them can go to hello@kimie.com.au.
Kimie is used by recruiting teams, through recruiter accounts created for the people at that team. You’re responsible for the accuracy of the information you provide when creating an account, for keeping your login details secure, and for activity that happens under your account. Candidates don’t create accounts or interact with Kimie directly — their data is submitted by the recruiter screening them.
Kimie is currently in Early Access and free to use. Pricing isn’t self-serve during Early Access — where a customer moves to a paid plan, we agree a Founding Price with that customer in advance, which they keep once Early Access ends. We won’t change what you owe, or start charging you, without agreeing that with you first. There are no specific price tables in these terms because pricing is negotiated per customer rather than published here.
You agree to use Kimie only for legitimate recruiting purposes, and not to:
Kimie reads candidate resumes against the criteria you set and proposes a per-criterion Verdict and an overall Score for each candidate, with quoted evidence behind each verdict. That output is decision support, not a hiring decision. The Decision to shortlist or reject a candidate is yours alone, made by you or your recruiting team — Kimie never makes that call itself, and we make no representation that a Verdict or Score is a correct or complete assessment of any candidate’s suitability for a role.
We own Kimie’s software, scoring logic, and product design, and nothing in these terms transfers that ownership to you. You retain ownership of the job descriptions, candidate data, and other content you submit to Kimie (“your content”). You grant us a licence to use your content solely to provide the service to you — to run scoring, store your data, and operate your account. We don’t use your content to train AI models; see the Privacy Policy for how AI processing works.
You can stop using Kimie and close your account at any time by contacting hello@kimie.com.au. We may suspend or terminate an account that breaches these terms, in particular the acceptable use commitments above, or where we reasonably believe continuing to provide the service would expose us or others to legal or security risk. Where practical, we’ll give you notice and a chance to fix the issue first. Sections that by their nature should survive termination — including intellectual property, liability, and this clause — continue to apply after your account closes.
To the maximum extent permitted by law, our total liability to you arising out of or in connection with Kimie is capped at the fees you’ve paid us in the 12 months before the claim arose. This cap doesn’t apply to liability that can’t be excluded or limited by law, or to liability arising from our gross negligence or fraud. Neither party is liable to the other for indirect or consequential loss.
Kimie is decision support, not the decision — see section 5. Because the shortlist or reject call on any candidate is always yours, you agree to indemnify us against third-party claims (including claims brought by a candidate) arising from your hiring decisions, except to the extent such a claim arises from our breach of these terms or our negligence in providing the scoring itself, in which case our liability is governed by the cap above rather than by this indemnity.
In turn, we’ll indemnify you against third-party claims that Kimie’s software (excluding your content and any other material you provide) infringes that party’s intellectual property rights, provided you let us control the defence and give us the information and cooperation we reasonably need. Neither indemnity in this section covers a claim that a Verdict, Score, or other AI output was inaccurate, incomplete, or discriminatory in effect — on either side, that risk is governed by the liability cap above rather than by an indemnity.
We’ll update this page as Kimie changes, particularly as we move from Early Access toward general availability and complete legal review. Where a change materially affects your rights, we’ll let you know before it takes effect. We’ll update the “last updated” date above whenever we make a change.
Questions about these terms, or anything covered by them, can go to hello@kimie.com.au. See also our Privacy Policy for how we handle personal information.
